House Taxation

There are 40 Legislative Days scheduled for the 2009 session. Standing Legislative Committees meet in regularly scheduled sessions during the morning hours of each Legislative Day. Some committees will hold special evening meetings. The House Taxation Committee is scheduled to meet Tuesday and Thursday at 7:45am in room 414 of the Capitol.

HB 1072 - increase the gross receipts tax imposed on visitor-related businesses.
HB 1073 - repeal certain sales and use tax exemptions and to revise certain sales and use tax exemptions.

HB 1011 - revise restrictions on the assignment and transfer of certain tax refund permits and refund claims.
15th Legislative Day
02/03/2009 Complete Meeting
HB 1197 - allow single-family dwellings that are under construction or listed for sale by contractors to be classified as owner-occupied single-family dwellings for the purpose of taxation.
HB 1195 - impose an income tax on interest and dividends and to provide penalties for the violation thereof.
HB 1131 - exempt the gross receipts from certain auctions from sales and use tax.
17th Legislative Day
02/05/2009 Complete Meeting
HB 1215 - transfer funds from the tax relief fund to the general fund and to revise certain provisions concerning the effective date of the collection allowance.
HB 1194 - repeal the contractor's excise tax.
HB 1190 - provide for the reduction of the sales and use tax on certain food items.

HB 1039 - repeal the discount on the sale of cigarette stamps to distributors.
HB 1231 - increase the exemption on the proceeds of the sale of certain homesteads.

HB 1255 - revise certain provisions concerning the telecommunications gross receipts tax.
HB 1273 - revise the conditions where the state may enter into tax collection agreements with Indian tribes.
HJR 1001 - Proposing and submitting to the electors at the next general election a new section to Article XI of the Constitution of the State of South Dakota, relating to the imposition of a corporate income tax.

02/17/2009 Complete Meeting
HB 1072 - increase the gross receipts tax imposed on visitor-related businesses.
HB 1256 - provide for a temporary increase in the sales and use tax and to declare an emergency.
HB 1073 - repeal certain sales and use tax exemptions and to revise certain sales and use tax exemptions.
HB 1009 - require certain tax refund claims for construction projects and certain documents and records in support of tax refund claims for construction projects to be filed within certain time periods.
HB 1276 - revise certain provisions regarding the eligibility for refunds of sales and use tax and contractor's excise tax and to require that certain information related to such refunds be public information.

HB 1073 - repeal certain sales and use tax exemptions and to revise certain sales and use tax exemptions.
HB 1072 - increase the gross receipts tax imposed on visitor-related businesses.
HB 1229 - increase the gross receipts tax imposed on visitor-related businesses and to revise certain provisions concerning the tourism promotion fund.
HB 1266 - impose a tax on the gross receipts of advertising services, to create the education advertising gross receipts tax fund, and to deposit the advertising gross receipts tax revenue in the education advertising gross receipts tax fund.
HB 1294 - repeal the methodology that assesses agricultural land based on its agricultural income value, to dissolve the implementation and oversight advisory task force, and to revise certain provisions concerning the assessment of real property.

SB 16 - revise certain provisions regarding the taxation of biodiesel and biodiesel blends.
SB 13 - revise certain provisions regarding the title to real property obtained by a tax deed.
SB 14 - revise certain provisions regarding references to the Internal Revenue Code and to repeal an obsolete reference to the Internal Revenue Code.
SB 12 - limit the amount of tax refunds for construction projects that are located in areas that are included in a tax collection agreement between the state and an Indian tribe.
31st Legislative Day
03/03/2009 Complete Meeting
SB 86 - revise certain provisions concerning the application of the inventory tax on certain fuels in storage immediately prior to a tax increase.
SB 21 - impose a fuel excise tax on ethyl alcohol and methyl alcohol used in motor vehicles on the public roads and highways, to repeal the fuel excise tax on ethanol blends and E85 and M85, and to revise certain provisions regarding the fuel excise tax.
SB 80 - revise the property tax levies for the general fund of a school district.
SB 161 - prohibit the use of federal income tax credits when assessing property.

SB 149 - revise certain provisions regarding the general fund levies of school districts.
SB 42 - provide an application deadline for sales and use tax refunds regarding certain storage facilities.
SB 4 - provide for additional responsibilities to the Agricultural Land Assessment Implementation and Oversight Advisory Task Force.
SB 3 - revise certain provisions concerning the assessment of agricultural land.
