Senate Education

There are 40 Legislative Days scheduled for the 2009 session. Standing Legislative Committees meet in regularly scheduled sessions during the morning hours of each Legislative Day. Some committees will hold special evening meetings. The Senate Education Committee is scheduled to meet Tuesday and Thursday at 7:45am in room 423 of the Capitol.

SB 39 - make an appropriation to the Department of Education to reimburse certain school districts for consolidation incentives and to declare an emergency.
SB 38 - require school districts to keep contiguous boundaries when reorganizing.
SB 34 - revise certain provisions regarding the South Dakota Board of Education's role if a school district fails to develop a reorganization plan.

HB 1046 - revise the eligibility requirements for the Richard Hagen-Minerva Harvey memorial scholarship award.
HB 1045 - repeal the provisions for the South Dakota Academic Achievement Test Advisory Council.
HB 1044 - define a multidistrict, career and technical academy and to provide provisions for the establishment of such an academy.
SB 87 - repeal the forthcoming mandate that, beginning on July 1, 2009, will require students to stay in school until age eighteen or graduation.
SB 88 - rescind the repeal on funding for sparse school districts that will take effect on June 30, 2009.

SB 117 - revise certain budgetary provisions relating to certain funds received from the federal government.
SB 81 - authorize the use of interscholastic activity admission fees by certain endowment funds.
SB 101 - clarify the school residence of a child assigned to an approved out of district special education residential or tuition day program when the residence of the child's parent or guardian changes.
SB 106 - revise certain provisions regarding the distribution of funds to sparse school districts, and to appropriate funds to distribute to sparse school districts.
17th Legislative Day

SB 112 - require that certain student meal plans be offered at public colleges and universities.
SB 145 - prohibit the transfer and subsequent expenditure of certain moneys appropriated to state aid to general and special education without specific legislative authorization.
SB 126 - revise certain provisions regarding school attendance.
SB 132 - allow resident students that attend school out of state to be counted in the resident school district's average daily membership for the purpose of distributing school and public lands funds.
SB 165 - provide for the authorization of certain private, nonprofit benevolent organizations to assist in funding certain school curricula, activities, and programs.
19th Legislative Day

SB 174 - require a school district to which a former contracting school district is annexed to assign certain resident students to a school district in a bordering state, and to temporarily exempt certain school districts from the requirement to reorganize due to low enrollment.
SB 172 - prohibit any school district from transporting students who participate in the enrollment options program beyond the boundaries of that school district.
SB 189 - revise certain provisions relating to payments to teachers obtaining certain national board certification.
SB 132 - allow resident students that attend school out of state to be counted in the resident school district's average daily membership for the purpose of distributing school and public lands funds.
SB 185 - revise the graduation requirements for students entering ninth grade in 2010 and thereafter by eliminating the option of the basic high school program.
SB 118 - adopt the interstate compact on educational opportunity for military children.
SB 91 - allow any school district, for a period of three years, to expend capital outlay funds for certain transportation costs, for the purchase of property and casualty insurance, and for energy costs, and the cost of utilities.

SB 106 - revise certain provisions regarding the distribution of funds to sparse school districts, and to appropriate funds to distribute to sparse school districts.
SB 140 - allow school districts to enter into contractual agreements to provide for the whole-grade sharing of students.
SB 190 - revise certain allocations for disabilities in the state aid for special education formula.
23rd Legislative Day

SB 189 - revise certain provisions relating to payments to teachers obtaining certain national board certification.
HB 1154 - revise certain requirements for eligibility for opportunity scholarships.
HB 1171 - exempt any school district from the minimum size requirement if it operates the only remaining public high school located within the boundaries of any county.
SB 126 - revise certain provisions regarding school attendance.
HB 1186 - reimburse and reward public school counselors who earn the credential of National Certified School Counselor.
25th Legislative Day
02/19/2009 Complete Meeting
SB 191 - establish eligibility criteria, community planning processes, and quality benchmarks for state-supported prekindergarten programs.
SB 132 - allow resident students that attend school out of state to be counted in the resident school district's average daily membership for the purpose of distributing school and public lands funds.
HB 1213 - allow school districts to enter into group health insurance contracts that include dental and vision insurance, and to allow school districts to offer group life and group health insurance benefits to retired employees.
28th Legislative Day

HB 1241 - clarify that certain special education placements are not suspensions or expulsions.
HB 1282 - allow counties to assign the responsibility for the redemption of bonded indebtedness of a former school district to a new school district after a reorganization.
31st Legislative Day
03/03/2009 Complete Meeting
HB 1297 - restrict the use of minor adjustments to school district boundaries and to revise the application process for minor boundary changes.
HB 1252 - repeal certain provisions relating to the education enhancement tobacco tax fund.
HB 1241 - clarify that certain special education placements are not suspensions or expulsions.
HB 1254 - exclude any federal stimulus funds in a school district's general fund when determining its allowable general fund balance.
HB 1067 - allow the voters of a school district to discontinue school board representation areas.
HB 1149 - allow a person or entity to offer postsecondary education credit in South Dakota while seeking accreditation from a recognized accrediting agency.

HB 1252 - repeal certain provisions relating to the education enhancement tobacco tax fund.
