House Commerce

There are 40 Legislative Days scheduled for the 2003 session. Standing Legislative Committees meet in regularly scheduled sessions during the morning hours of each Legislative Day. Some committees will hold special evening meetings. The House Commerce Committee is scheduled to meet Tuesday and Thursday at 7:45am in room 464 of the Capitol.

HB 1085 - require that financial institutions obtain consent before sharing a consumer's personally identifiable information with nonaffiliated third parties.

SB 43 - conform medicare supplement plans to general delivery receipt requirements.
SB 44 - revise certain investigative and enforcement procedures regarding fraternal benefit societies.
SB 45 - repeal certain surplus lines broker licensing requirements.
SB 47- increase the maximum fee that may be established for licensed practical nurses, registered nurses, certified registered nurse anesthetists, clinical nurse specialists, certified nurse midwives, and certified nurse practitioners.
HB 1090 - provide that certain vehicle leases are not sales or security interests.

HB 1161- require a permit of persons engaged in certain plumbing activities.
HB 1175 - provide for a permit system for plumbing.
HB 1241- designate certain counties as economic improvement areas and to establish the interest rate for revolving economic development initiative loans in economic improvement areas.
HB 1123 - clarify certain circumstances relating to the termination or discontinuance of certain dealership contracts.

SB 46 - repeal certain provisions providing for the registration of audiology aides.

HB 1276- transfer the regulation of real estate appraisers from the Department of Commerce and Regulation to the Real Estate Commission.
HB 1181- establish a comprehensive health association to provide health insurance coverage to eligible persons.
SB 41- provide for the creation of a no solicitation calls list for persons wishing not to receive unsolicited telephone calls, to create a telephone solicitation account, and to establish certain fees and civil penalties.

HB 1164- allow certain merchandising agreements between cigarette retailers and cigarette manufacturers and to place certain prohibitions on cigarette manufacturers.
HB 1181- establish a comprehensive health association to provide health insurance coverage to eligible persons.

SB 33-  revise certain provisions relating to telemarketing.
SB 48- include reverse distributors in the definition of wholesale drug distributors.
SB 49- authorize the Board of Pharmacy to promulgate rules regarding the reference publications required for each licensed pharmacy.
SB 50- apply the requirements for utilization review and independent audits to farm mutual insurers.
SB 51- authorize the Board of Counselor Examiners to limit the number of times an examination may be taken before exhausting the original application.
SB 52- revise certain provisions relating to plumbing standards.
SB 53- clarify licensure renewal for licensed counselors.

SB 187- clarify the authority of counties to grant certain utility easements for the installation of underground cable.
SB 98- revise certain organizational and administrative provisions related to consumer power 
SB 54- revise certain provisions relating to notes to insurance company financial reports.
SB 56- revise and update certain provisions related to the South Dakota Life and Health Insurance Guaranty Association.
SB 79- extend the time frame that the Housing Development Authority has to submit its annual report to the Governor and Legislature.
SB 87- permit bonding authorities to enter into contracts for the purpose of managing payments or interest rate risk.
SB 88- separate agricultural equipment credit transactions from certain consumer installment sales contracts.
SB 121-  revise certain penalties for violations relating to alcoholic beverage licenses.
SB 154- authorize certain interstate shipments of wine, to establish certain penalties, and to collect sales tax.
SB 156- revise certain provisions to provide workers' compensation benefits to children of deceased employees.

3/4/03

SB 149-  revise certain provisions related to the sale or marketing of unstamped cigarettes.
SB 167- revise the determination of minimum nonforfeiture amounts for individual deferred annuities and to provide for a sunset of the revision.
SB 168- revise certain provisions regarding variable life insurance policies.
SB 171- provide for certain asset-backed securitizations.
