House Judiciary

There are 35 Legislative Days scheduled for the 2008 session. Standing Legislative Committees meet in regularly scheduled sessions during the morning hours of each Legislative Day. Some committees will hold special evening meetings. The House Judiciary Committee is scheduled to meet Monday, Wednesday and Friday at 7:45am in room 464 of the Capitol.

HB 1030 - revise certain provisions regarding the appointment of notaries public and the requirements of notary public seals.
HB 1001 - provide for a jury trial in forfeiture proceedings.
HB 1054 - authorize the State Brand Board to impose certain civil penalties.
HB 1055 - revise the penalty for leaving the brand inspection area without a brand inspection.
HB 1034 - revise the definition of worker misconduct for the purposes of workers' compensation claims.

HB 1104 - revise certain provisions regarding the liability of a garnishee to a plaintiff after the service of a summons.
HB 1113 - provide minimum notice requirements to persons who lease real property for their own mobile or manufactured homes.
HB 1059 - repeal the restriction on the number of personnel to be employed by the Office of the Attorney General's consumer complaint program.
HB 1060 - revise the statute of limitations regarding deceptive trade practices.
HB 1066 - revise certain provisions regarding deceptive trade practices.
HB 1111 - revise the responsibilities of the Corrections Commission and to require an annual report of Corrections Commission activities.

HB 1088 - revise certain provisions relating to temporary custody prior to divorce or separate maintenance.
HB 1102 - provide for a statewide visitation enforcement program and to provide for its funding by making an appropriation therefor.
HB 1096 - authorize the court appointment of parenting coordinators in certain custody and visitation disputes.
HB 1061 - revise the penalty for the distribution or possession with intent to distribute marijuana to a minor.
HB 1062 - include officers of the National Park Service in the definition of a federal law enforcement officer.
HB 1098 - revise certain provisions relating to the rights of alleged contemnors in visitation and custody matters.
HB 1097 - provide for the imposition of certain sanctions against parties who willfully do not comply with custody or visitation decrees.
HB 1099 - require custody or visitation dispute mediation under certain circumstances.
HB 1089 - revise certain provisions relating to the rights and duties of joint legal custodians.
HB 1090 - require that most records and applications regarding a child reference the names and addresses of both parents.
HB 1094 - repeal certain provisions concerning the rights of custodial parents that have been superseded by other statutes.
HB 1091 - provide that either parent is to reasonably inform the other parent about routine decisions concerning children when residing with the other.
HB 1093 - revise certain provisions relating to the custody, service, and earnings of children.
HB 1095 - adopt the South Dakota Family Law Arbitration Act and provide for its implementation and enforcement.
HB 1092 - revise certain terminology in the statutes providing for standard child visitation guidelines.
HB 1101 - provide for an order of joint physical care over certain children whose parents exercise joint legal custody and to create a rebuttable presumption against joint legal custody and joint physical custody under certain circumstances.
HB 1100 - create a rebuttable presumption against the award of custody to any person with a proven history of domestic abuse.

HB 1131 - permit the court to assess the crime victims' compensation surcharge in cases involving certain adjudicated children.

HB 1253 - require that home studies conducted for custody determinations be completed by certain professionals.
HB 1122 - increase the jurisdictional amount in certain civil actions and small claims proceedings.
HB 1201 - revise certain provisions regarding the placement or return of abused or neglected children.

HB 1260 - revise sex offender registry provisions for persons without a residence address.
HB 1162 - prohibit the branding of a minor and to provide a penalty therefor.
HB 1163 - increase the duration of juvenile diversion programs.
HB 1217 - authorize the creation of a circuit court judgeship in the Seventh Judicial Circuit and to make an appropriation therefor.
HB 1141 - prohibit the implanting of a microchip and provide a civil recovery.
HB 1238 - revise the limitation period for commencing child abuse prosecutions.

HB 1239 - permit persons convicted of driving under the influence to operate a vehicle for 24/7 sobriety testing and to declare an emergency.

HB 1157 - revise certain provisions relating to the residency or military presence of parties in divorce or separate maintenance proceedings.
