Senate Commerce

There are 35 Legislative Days scheduled for the 2008 session. Standing Legislative Committees meet in regularly scheduled sessions during the morning hours of each Legislative Day. Some committees will hold special evening meetings. The Senate Commerce Committee is scheduled to meet Tuesday and Thursday at 10am in room 413 of the Capitol.

SB 30 - revise the minimum fire safety standards for specialty resorts.
SB 37 - establish certain suitability requirements for annuities.
SB 41 - revise certain provisions regarding the regulation of public storage warehouses.
SB 11 - revise certain provisions regarding corrosion protection for tank piping systems and aboveground tanks containing flammable or combustible liquids and used in retail motor fuel dispensing operations.
SB 16 - require continuing education of plumbing contractors, plumbers, apprentice plumbers, restricted plumbing contractors, and restricted plumbers.
SB 36 - revise the discount medical plan organization's renewal period requirements.

SB 39 - revise certain provisions regarding the suspension, implementation, and refund of electric or natural gas rates.
SB 43 - revise the requirements regarding the siting of energy facilities.
SB 17 - revise certain provisions regarding the regulation of banks.
SB 32 - establish a separate licensure category for vacation home establishments and to require vacation home establishments to meet minimum fire safety standards.
SB 30 - revise the minimum fire safety standards for specialty resorts.

SB 52 - revise certain provisions regarding the regulation of franchises and business opportunities.
SB 81 - allow persons to place a security freeze on their credit reports without first being victims of identity theft.

SB 97 - revise certain provisions regarding property condition disclosure statements.
SJR 2 - To propose a constitutional amendment to repeal the right to work provisions of the State Constitution.
SB 94 - repeal certain provisions relating to the right to work upon the contingency of repealing the right to work provisions of the Constitution.
SB 35 - establish fair claims standards and procedures for property casualty insurance claims.

SB 103 - establish certain provisions regarding the use of replacement crash parts in the repair of certain motor vehicles.
SB 157 - revise the surety bond requirements for persons employed by mortgage brokerages.
SB 128 - revise certain provisions regarding the modification of credit card agreements.
SB 158 - clarify certain provisions regarding the supervision, rehabilitation, and liquidation of insurers.

SB 145 - revise the definition of an opportunity wage for the purposes of the minimum wage requirement.
SB 119 - prohibit insurers or adjusters from knowingly underestimating the value of an insurance claim and to establish a penalty.
SB 195 - create the South Dakota Commission on Higher Pay and Economic Prosperity, to prescribe its duties, and to make an appropriation therefor.
SB 166 - require employers that employ certain foreign workers to pay a certain wage.
SB 146 - repeal certain provisions regarding the minimum wage for tipped employees.

SB 177 - revise certain provisions regarding the disposal of abandoned tenant's property left on leased residential premises.
SB 202 - prohibit certain military sales practices for life insurance and annuities.
HB 1013 - remove certain waiting periods for property casualty filings.
HB 1002 - revise the style and form of certain provisions and to delete certain obsolete provisions regarding labor and employment and the Department of Labor.
HB 1003 - revise the style and form of certain provisions and to delete certain obsolete provisions regarding unemployment compensation.
HB 1004 - revise the style and form of certain provisions and to delete certain obsolete provisions regarding workers' compensation.

HB 1118 - authorize the issuance of special off-sale package wine dealers licenses.
HB 1126 - revise certain provisions regarding the issuance of on-sale wine licenses and the sale of wine.
HB 1072 - revise the intent of the appointments of panels for voluntary review of certain first level health care decisions.

HB 1035 - revise the definition of an employer's actual knowledge of injury for the purposes of workers' compensation claims.
HB 1036 - require releases for certain workers' compensation medical records and to establish copying costs.
HB 1037 - revise certain provisions regarding medical claims for workers' compensation and to establish an administrative fine for delays regarding these medical claims.
HB 1113 - provide minimum notice requirements to persons who lease real property for their own mobile or manufactured homes.

HB 1159 - revise certain provisions regarding franchise protection for certain types of merchandise.
HB 1211 - revise the audit requirements for farm mutual insurers.
HB 1190 - prohibit lodging establishments from automatically charging a fee for a safe.
HB 1203 - provide for the sale or consumption of alcoholic beverages upon property adjoining licensed premises.
HB 1200 - clarify the computation for premium tax payable for individual life insurance policies purchased by South Dakota residents.
HB 1194 - revise certain provisions regarding group life insurance policies.
24th Legislative Day

HB 1210 - prohibit recyclers, scrap metal dealers, or scrap yard operators from purchasing certain beer kegs.
HB 1256 - require certain disclosures when selling labor law posters to employers.
HB 1212 - allow the marketing of group insurance for wireless telecommunications equipment under certain conditions.
HB 1213 - provide a uniform standard for processing of accident and health carrier policy rate and form filings.
HB 1139 - revise certain provisions of the South Dakota Business Corporations Act regarding the issuance of shares and cumulative voting for directors.
HJR 1001 - To propose a constitutional amendment to repeal certain provisions of the State Constitution relating to corporations.
26th Legislative Day

HB 1265 - prohibit the sale, purchase, use, or possession of alcohol without liquid devices.
HB 1136 - revise certain provisions regarding the registration of business names.
HB 1258 - require that certain gift certificates conspicuously disclose information regarding fees and expiration dates.
HB 1290 - exempt certain entities from certain requirements for persons in the business of mortgage lending.
HB 1269 - allow a beer and wine combination license.
