South Dakota Attorney General Marty Jackley is joining a coalition asking the Supreme Court to allow parents to sue a Wisconsin school over its gender protection plan.
In 2021 the Eau Claire Area School District established a policy to support students’ gender identity. School officials said it is designed to “address the needs of transgender, nonbinary, and/or gender non-conforming students.”
The district said due to the sensitivity of the topic, on occasion the student would be talked to first, before their parents, if safety concerns at home could arise.
Parents argue this impedes their rights to be involved in the educational and personal development of children.
No such instance has occurred yet, according to Wisconsin Public Radio.
The case was thrown out of the Seventh Circuit Court of Appeals this March, with the judge saying parents were being speculative.
Jackley is one of 16 state attorneys general who signed an amicus petition issued Monday urging the Supreme Court to “bring clarity, before more parents and children are injured”.
