US Senate removes state AI moratorium before passing reconciliation bill

Before passing the budget reconciliation bill, the US Senate removed a contested provision that would have affected the state’s ability to write laws on Artificial Intelligence, or AI.

It would have enacted a 10-year prohibition on states from enforcing or regulating any type of legislation on AI.

South Dakota has laws banning AI use to generate child pornography and against using AI generated material to influence an election.

The provision was opposed by multiple South Dakota state legislators, Gov. Larry Rhoden and Attorney General Marty Jackley.

Jackley said it “would have kept states from enforcing deep fake child pornography and election integrity laws.”

Senators voted 99-1 to remove the provision. Both Sen. John Thune and Sen. Mike Rounds voted to remove the provision.
