Attorney General Marty Jackley said, in his opinion, a new law requiring the Secretary of State to update the statewide voter registration file does not conflict with existing laws that limit voter registration information.
HB 1062 went into effect July 1 and requires the Secretary of State’s office to post weekly statewide voter registration updates on their website.
Sioux Falls Rep. Taylor Rehfeldt asked the attorney general to clarify if the new law conflicts with existing law.
Specifically, if the new law conflicts with statute that prohibits information obtained from the statewide voter registration file from being placed for unrestricted access on the internet.
Jackley said in his advisory opinion while they initially appear to conflict, the “Secretary of State’s office has established a request procedure that gives full effect to the requirements of both.”
To access the file, people must fill out an online request form and acknowledge they won’t use it for commercial or other specified uses, then they receive access to a onetime use link that expires after 12 hours.
